Terms of Service
Effective 16 September 2026 · Last updated 16 September 2026
These terms are the agreement between you and Ovio Labs LLC about your use of OVIO. Using the app means you accept them. If you do not, please don't use the app.
1. What OVIO is
OVIO recommends places, cafés, libraries, parks, and similar, and estimates how calm or busy they are likely to be, using public data, forecasts, and feedback from other people who have been there.
These are estimates, not promises. Opening hours change, venues close, a quiet café has a loud afternoon. Check before you travel. We are not responsible for a wasted journey, and we have no relationship with, and no control over, the venues described.
OVIO is not a medical or therapeutic service. It is not a medical device, it does not diagnose or treat anything, and nothing in the app is medical, psychological or clinical advice. If you are looking for support with your health, please speak to a qualified professional.
2. Who may use it
You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms on your behalf. You agree to use OVIO only for lawful purposes.
3. Subscriptions and payment
OVIO offers a free tier and a paid tier, OVIO Pro. Pro is sold as an auto-renewing subscription, and is also offered as a one-time purchase where indicated.
- Price and term are shown in the app before you buy, in your local currency, as supplied by Apple.
- Payment is charged to your Apple Account when you confirm the purchase.
- Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the period ending, at the price of the plan you chose.
- Manage or cancel in Settings → your name → Subscriptions on your device. Deleting the app does not cancel a subscription.
- A one-time purchase, where offered, grants access for as long as we operate the service. It is not a guarantee that the service will run forever.
- Fair-use limits apply to both tiers. Concierge requests carry a daily allowance, a much larger one on Pro than on the free tier, but not an unlimited one. We may adjust it to keep the service running for everyone.
Purchases are handled by Apple, not by us. Refunds are Apple's to give, under their terms, we cannot issue them. If something has gone wrong, write to us anyway; we would rather know.
We may change prices or what each tier includes. If a change affects an existing subscription, we will tell you beforehand and you will have the chance to cancel before it takes effect.
Paid features depend on third-party data services. If one becomes unavailable we will do our best to restore or replace it, but a temporary interruption is not a breach of these terms.
4. AI-generated content
The OVIO concierge composes its answers using a large language model. Those answers may be inaccurate, incomplete, or confidently wrong about a real place. They are suggestions to consider, not facts to rely on, and never a substitute for professional advice or your own judgement about your safety.
Every answer carries a way to report it. Please use it when something is wrong. We review reports and act on them, though we cannot promise a reply to each one.
Using the concierge requires your consent to your requests being sent to our AI provider. The Privacy Policy sets out exactly what is sent.
5. What you contribute
When you vouch for a venue or adjust its fine-tune values, you are adding to a shared picture other people rely on. So:
- Describe your honest experience of the place.
- Do not submit anything false, defamatory, harassing, discriminatory, or aimed at damaging a business you have a grievance with.
- Do not submit anything unlawful, or anything you have no right to submit.
You keep ownership of what you submit. You grant us a worldwide, royalty-free licence to use, store, reproduce, aggregate and display it in connection with OVIO, in practice, to pool it into the venue scores everyone sees. We may remove any contribution, at our discretion, without notice.
6. Things you agree not to do
- Reverse-engineer, decompile, or tamper with the app or our servers, except where the law says you may.
- Scrape, bulk-download, or resell our data or the venue information in the app.
- Use automated systems to access the service, or attempt to circumvent rate limits, quotas, paid-tier restrictions, or authentication.
- Interfere with the service or with anyone else's use of it.
- Use OVIO to stalk, harass, or locate a specific person.
7. Availability
We do not promise that OVIO will be uninterrupted or error-free. We may change, suspend or discontinue features, or the whole service, at any time. If we discontinue a paid feature you have already paid for, we will offer a pro-rata refund through Apple or an equivalent remedy.
8. Your data
How we handle your information is described in the Privacy Policy, which forms part of these terms. You can erase everything we hold about you from inside the app at any time.
9. Intellectual property
OVIO, its name, design, and software are ours and remain ours. These terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own purposes. Nothing more transfers to you.
Venue data comes from third-party sources including Google, OpenStreetMap, Wikipedia and Wikidata, and remains subject to their respective licences.
10. Ending this agreement
You may stop using OVIO at any time, and delete your data from within the app. We may suspend or terminate your access if you breach these terms or use the service in a way that harms others or us. Sections 4, 5, 11, 12 and 13 survive termination.
11. Disclaimers
To the fullest extent the law allows, OVIO is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that venue information, busy-ness forecasts, or concierge answers are accurate, current or complete.
12. Limitation of liability
To the fullest extent the law allows, neither Ovio Labs LLC nor anyone working with us is liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of OVIO.
Our total liability for any claim relating to OVIO is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.
Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing here limits liability that cannot lawfully be limited.
13. Governing law
These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought in the state or federal courts located in Missouri, and both of us consent to their jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws where you live.
14. Apple
These terms are between you and Ovio Labs LLC, not Apple. Apple is not responsible for OVIO or its content and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. If OVIO fails to conform to any applicable warranty, you may notify Apple, who may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to OVIO.
15. Changes to these terms
We may update these terms. If a change is material, we will update the date above and notify you in the app. Continuing to use OVIO after a change means you accept the revised terms.
